1. About these Terms

Gergasi (https://gergasi.school) is a live online tutoring platform run by Karyatama (registration no. [SSM registration number]), Kuala Lumpur, Malaysia ("Gergasi", "we", "us"). Students book live classes with teachers, pay for them with credits, and practise with games such as Power Congak.

By creating an account or using Gergasi you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Gergasi.

2. Who can use Gergasi

• There is no minimum age. If you are under 18, your parent or guardian must agree to these Terms for you, and they are responsible for your account, your purchases and how you use Gergasi.
• Give true details when you sign up, keep your password to yourself, and use only your own account. You are responsible for everything done with your account.
• One account per person. Teacher accounts are checked by Gergasi before they can teach.

3. Credits and payments

• Classes are paid for with credits, bought in Wallet → Buy credits. The price of each package is shown before you pay.
• Payments are handled by our payment provider, Billplz. The payment method you choose may add a processing fee. It is shown before you pay and goes to the payment provider, not to Gergasi. We never see or store your card or banking login details.
• Credits do not expire. They stay in your account for as long as the account is open. Unused credits are lost only if the account is closed for breaking these Terms (see section 12).
• Credits are not money. They cannot be exchanged for cash, sold, or moved to another account, except as a refund under section 4.
• Promotional or bonus credits given free, and sponsored credits (section 9), have no cash value.

4. Refunds

• Payment problems. If you were charged but the credits never arrived, or you were charged twice, tell us and we will fix it or refund the payment in full.
• Unused credits. Paid credits you have not used can be refunded if you ask within 14 days of buying them. The payment provider's processing fee is not refundable.
• Cancelled classes. When you cancel in time, or your teacher or Gergasi cancels, the credits held for that class go straight back to your balance. You are never charged for a class that did not happen.
• Our fault. If a class could not go ahead properly because of a fault on Gergasi's side, contact us and we will return the credits for that class.
• No refund for a class you attended, including a class you were removed from under section 6.
• Closing your account. If you close your account yourself, unused paid credits bought in the last 14 days can be refunded on request. If we close an account for breaking these Terms, its credits are not refunded.

To ask for a refund, use "Contact admin" in your dashboard or email support@gergasi.school. Refunds go back to the original payment method.

5. Booking and cancelling classes

• When you book a class, its price in credits is held. Held credits cannot be used for anything else. They are only charged once you have attended the class.
• Students can cancel a booking up to 15 minutes before the class starts. The held credits return to your balance in full. After that, the booking can no longer be cancelled.
• Teachers can cancel a class up to 60 minutes before it starts, and must give a reason. Every booked student is told straight away and their held credits are returned.
• Class times are shown in Malaysia time (GMT+8).

6. Class rules - the rules of Gergasi

Our classes are for learning, and many of our students are children. Everyone in a class must be respectful and follow the teacher's instructions.

• No bullying, hate, sexual content, threats, spam or advertising, in the class, in messages or in names and pictures.
• Teachers and students must not arrange to meet, pay or be paid outside Gergasi for classes found on Gergasi.
• If anything in a class makes you feel unsafe, press the Safety button. Gergasi's team is alerted straight away.
• Breaking these rules can lead to a warning, suspension or closure of the account (section 12). You can appeal a warning from your dashboard.

7. Recording

• Some parts of your class will be recorded by Gergasi for monitoring - keeping students safe, checking the quality of teaching and settling complaints - and for promotion.
• Everyone in the class is told when Gergasi records.
• We will not use a recording that shows a student's face, voice or name in promotion without the consent of that student or, if they are under 18, their parent or guardian.
• How we keep and protect recordings is explained in our Privacy Policy.

8. Teachers

• Teachers must pass Gergasi's checks before teaching and keep their profile and qualifications true and current.
• Teachers are independent. They are not employees or agents of Gergasi, and are responsible for their own taxes.
• Teachers set their class prices in credits. Gergasi keeps a commission on each paid class. It starts at 25% and goes down with every completed paid class, to 15% after 1000 classes. Tips go to the teacher in full.
• Earnings can be paid out once they have cleared, 7 days after the class, when the balance is at least RM50.
• Teachers are responsible for the material they use and must have the right to use it.
• Teachers must follow section 6 and treat every student fairly and safely. Gergasi may hold or refuse earnings from a class that broke these Terms, and may recover earnings paid for such a class.

9. Sponsored credits (Credit Reservoir)

The Credit Reservoir collects contributions from the public, companies and supporters to pay for classes for students who cannot afford them. Credits given to a student from the Reservoir:

• can be used only to book classes. They cannot be used for tips or for Power Congak Battle voice chat;
• are used before the student's own credits when a class is booked;
• cannot be refunded, exchanged for cash or moved to another account;
• may be taken back if they are misused.

Contributions to the Reservoir are not refundable once the payment is complete, except for a payment error. Gergasi is not a registered charity, and contributions are not tax-deductible.

10. Power Congak and points

Power Congak games and points are for learning and fun. Points, badges and ranks have no cash value and cannot be exchanged. Your display name may be shown on leaderboards. We may reset points that were gained unfairly.

11. Content and ownership

• Gergasi, its design, question banks and games belong to Gergasi.
• Teachers keep ownership of the material they create. They allow Gergasi to show it to their students and to store it for running the service.
• You may use class material for your own learning only.

12. Warnings, suspension and closing an account

• If these Terms are broken we may warn, suspend or close the account, depending on how serious it is. We act straight away when a child's safety is at risk.
• You can close your account at any time through "Contact admin" in your dashboard.

13. Our responsibility to you

• We work hard to keep Gergasi running, but it depends on the internet, your device and outside services (video, payments), so we cannot promise it will always be available or free of errors.
• We are not responsible for loss that we could not reasonably have foreseen, or for anything outside our control.
• If we are responsible for a loss, our total liability is limited to what you paid Gergasi in the 3 months before it happened.
• Nothing in these Terms takes away your rights under Malaysian law, including the Consumer Protection Act 1999.

14. Changes to these Terms

We may update these Terms. When the change matters, we tell you by email or in the app before it takes effect. If you keep using Gergasi after that, the new Terms apply.

15. Law and contact

These Terms are governed by the laws of Malaysia, and the courts of Malaysia can hear any dispute. If the English and Bahasa Melayu versions differ, the English version applies.
